Terms of Service

These terms are an agreement between you and Noch Operations LLC (“InfinitySMS”, “we”, “us”) governing your use of the InfinitySMS platform at infinitysms.io. By creating an account or using the service you accept these terms.

InfinitySMS provides tools to send and manage SMS campaigns, including A2P 10DLC brand and campaign registration, contact management, a two-way inbox, and analytics. We may add, change, or remove features as the product evolves.

You are responsible for the messages you send. You agree to:

• Message only recipients who have given you appropriate consent to be contacted, as required by the TCPA and other applicable laws in your recipients’ jurisdictions.
• Honor opt-outs immediately and never attempt to bypass the platform’s opt-out enforcement.
• Identify yourself truthfully as the sender; no misleading or deceptive content.
• Not send prohibited content (per carrier rules), including SHAFT content (sex, hate, alcohol, firearms, tobacco), phishing, or content that is illegal in the recipient’s jurisdiction.
• Provide accurate business information for A2P 10DLC registration.

We may suspend or terminate accounts that violate carrier rules or messaging laws — this protects the deliverability of every customer on the platform.

Pricing is displayed at checkout and on our pricing page — a monthly platform subscription plus per-message usage, billed through Stripe. Usage charges are metered per message segment. Subscriptions renew automatically until cancelled; you can cancel anytime and retain access through the end of the paid period. Fees are non-refundable except where required by law.

You retain ownership of the contact lists, messages, and other content you bring to the platform. You grant us the limited rights needed to operate the service (for example transmitting your messages to carriers). You are responsible for having the legal right to use the contact data you upload.

The service is provided “as is”. Message delivery depends on telecommunications carriers we do not control, and we do not guarantee delivery of any individual message. To the maximum extent permitted by law, our total liability for any claim is limited to the amounts you paid us in the three months before the claim arose, and we are not liable for indirect or consequential damages.

You may close your account at any time. We may suspend or terminate accounts for violation of these terms, non-payment, or risk to the platform. On termination we will make your exportable data available for a reasonable period on request.

We may update these terms; material changes will be notified via the service or email, and continued use constitutes acceptance. Questions: support.infinitysms.io or support@infinitysms.io.
